Lay-By Terms & Conditions – Mackay Cycles

Full Terms & Conditions

1. Overview

These Lay-By Terms & Conditions are provided in accordance with the Australian Consumer Law (ACL). By placing a lay-by with Mackay Cycles, you agree to these terms. A written copy of this agreement will be provided in-store or electronically – please keep it for your records.

2. Term & Ownership

• Lay-bys are available for a maximum of 3 months.
• Goods remain the property of Mackay Cycles until paid in full.
• Once final payment is received, goods may be collected in-store.

3. Deposit & Payments

• A 10% deposit of the total purchase price is required to start a lay-by.
• Regular payments can be made in-store, via direct debit, or through a secure payment link sent via text message (on request).
• It is recommended that payments are made fortnightly or monthly to stay on track within the 3-month term.

4. Cancellation by the Customer

Customers may cancel their lay-by at any time. Refunds will be made minus the following applicable fees:

• Cancelled within 4 weeks – $50 administration fee
• Cancelled after 4 weeks (up to 3 months) – $50 administration fee
• Cancelled after the 3-month term – 20% of the total sale price

These fees reflect the reasonable costs incurred by Mackay Cycles for administration, stock holding, and resale preparation.

5. Cancellation by Mackay Cycles

Mackay Cycles may cancel a lay-by agreement only if payments are not made as agreed, if goods are no longer available (e.g. discontinued or supplier issue), or if Mackay Cycles ceases trading. If the lay-by is cancelled by Mackay Cycles, all payments will be refunded in full.

6. Changes or Extensions

Any changes to a lay-by agreement, including item swaps or extensions, must be approved by management and may incur a small administration fee.

7. Collection

Goods can only be collected once payment is complete. If a lay-by is not finalised or collected within the 3-month term, Mackay Cycles may cancel the agreement and apply the applicable fees listed above.

8. Consumer Guarantees

Your rights under the Australian Consumer Law – including refunds or replacements for faulty or misdescribed goods – apply in addition to these lay-by terms and conditions.
